Introduction

Welcome to Bygone. These Terms of Use govern your access to and use of the Bygone mobile weather application. By downloading, installing, or using the app, you agree to be bound by these terms. If you do not agree to these terms, please do not use the app.

Subscription Services

Bygone offers premium features through subscription-based access. By subscribing, you gain access to enhanced weather features, advanced forecasts, and additional functionality.

What You're Paying For

Your subscription provides access to:

• Extended weather forecasts beyond the free tier
• Advanced weather comparisons and historical data
• Customizable weather notifications and alerts
• Ad-free experience
• Priority customer support
• Access to premium features as they are released

Subscription Plans and Pricing

We offer various subscription plans with different billing periods. Subscription prices are displayed in the app and may vary by region. All prices include applicable taxes unless otherwise stated.

Available subscription options may include:

• Monthly subscription
• Annual subscription
• Other promotional or special pricing periods

Billing and Auto-Renewal

How Billing Works

Payment will be charged to your Apple ID account at confirmation of purchase. Subscriptions are processed through Apple's App Store, and all payments are handled in accordance with Apple's payment terms.

Automatic Renewal

Your subscription will automatically renew unless auto-renewal is turned off at least 24 hours before the end of the current subscription period.

Your account will be charged for renewal within 24 hours prior to the end of the current period. The renewal charge will be the same as your initial subscription price unless you have been notified otherwise.

How to Cancel Your Subscription

You can cancel your subscription at any time. Cancellation takes effect at the end of your current billing period, and you will retain access to premium features until that time.

Cancellation Steps

To cancel your subscription:

1. Open the Settings app on your iOS device
2. Tap your name at the top of the screen
3. Tap "Subscriptions"
4. Select the Bygone subscription
5. Tap "Cancel Subscription"

Alternatively, you can manage your subscriptions directly through the App Store app or at apps.apple.com/account/subscriptions.

Important: Deleting the app does not cancel your subscription. You must explicitly cancel through your Apple ID subscription settings.

Free Trials

We may offer free trial periods for new subscribers. If a free trial is available, the trial period will be clearly displayed before you subscribe.

Important: Unless you cancel at least 24 hours before the end of the free trial period, you will be automatically charged for a subscription at the then-current subscription price.

Refunds and Returns

All purchases are processed through the Apple App Store and are subject to Apple's refund policies. We do not have the ability to issue refunds directly.

Requesting a Refund from Apple

If you believe you are entitled to a refund, you can request one from Apple:

• Visit reportaproblem.apple.com
• Sign in with your Apple ID
• Find the Bygone subscription charge
• Select "Report a Problem" and follow the instructions

Note: Refund requests are reviewed and approved by Apple on a case-by-case basis. We cannot guarantee that a refund will be granted. Generally, refunds are not provided for:

• Subscriptions that have already been used or consumed
• Failure to cancel before the renewal date
• Change of mind after the purchase

Price Changes

We reserve the right to modify subscription pricing at any time. Price changes will not affect your current subscription period, but will apply to subsequent renewal periods.

You will be notified of any price changes in advance. Continued use of the subscription after a price change constitutes acceptance of the new price.

Account and Access

Your subscription is tied to your Apple ID and cannot be transferred to another account. You are responsible for maintaining the security of your Apple ID.

We reserve the right to suspend or terminate access to the app and subscription services if you violate these terms or engage in fraudulent activity.

Service Availability

While we strive to provide uninterrupted service, we do not guarantee that the app will be available at all times. The service may be temporarily unavailable due to:

• Scheduled maintenance
• Technical issues or system failures
• Weather data provider outages
• Circumstances beyond our control

We are not liable for any loss or inconvenience resulting from service interruptions.

Content Accuracy

Weather forecasts and data are provided for informational purposes only. While we use reliable data sources, we cannot guarantee the accuracy, completeness, or timeliness of weather information.

You should not rely solely on the app for decisions involving safety, health, or property. Always consult official weather services for critical weather information.

Intellectual Property

The app and its content, including but not limited to text, graphics, logos, icons, and software, are the property of Bygone and are protected by copyright and other intellectual property laws.

You may not copy, modify, distribute, sell, or lease any part of the app or its content without our express written permission.

User Conduct

You agree not to:

• Use the app for any unlawful purpose
• Attempt to reverse engineer, decompile, or disassemble the app
• Use any automated system to access the app
• Interfere with or disrupt the app or servers
• Attempt to gain unauthorized access to any part of the app
• Share your subscription access with others

Limitation of Liability

To the maximum extent permitted by law, Bygone and its affiliates, officers, employees, and partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from:

• Your use or inability to use the app
• Weather information inaccuracies
• Service interruptions or errors
• Data loss or corruption
• Any other matter relating to the app

Disclaimer of Warranties

The app is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to:

• Warranties of merchantability
• Fitness for a particular purpose
• Non-infringement
• Accuracy or reliability of weather data

Privacy

Your use of the app is also governed by our Privacy Policy, which can be found at bygoneweather.com/privacy-policy. Please review the Privacy Policy to understand how we collect and use your information.

Changes to These Terms

We may update these Terms of Use from time to time. Changes will be posted on this page with an updated "Last updated" date. Material changes will be communicated to you through the app or via email if applicable.

Continued use of the app after changes to these terms constitutes acceptance of the updated terms. If you do not agree to the changes, you should cancel your subscription and discontinue use of the app.

Governing Law

These terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Bygone operates, without regard to its conflict of law provisions.

Apple-Specific Terms

The following terms apply specifically to your use of the app through Apple's App Store:

• These terms are between you and Bygone only, not with Apple. Apple is not responsible for the app or its content.
• Apple has no obligation to provide maintenance or support services for the app.
• In the event of any failure of the app to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any). To the maximum extent permitted by law, Apple has no other warranty obligation.
• Apple is not responsible for addressing any claims you have relating to the app or your use of it.
• Apple and Apple's subsidiaries are third-party beneficiaries of these terms, and upon your acceptance of these terms, Apple will have the right to enforce these terms against you.

Severability

If any provision of these terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms of Use will otherwise remain in full force and effect.

Entire Agreement

These Terms of Use, together with our Privacy Policy, constitute the entire agreement between you and Bygone regarding the use of the app and supersede all prior agreements and understandings.
